Terms of service
The short version
- Cairn is in early access and free while it is. We will give you at least 30 days' notice before any charge, and nothing is charged without your agreement.
- Your data, and your clients' data, stay yours. We use them only to run Cairn for you.
- You need your clients' permission for the accounts you connect, and you are responsible for what you publish to them.
- Rankings are measurements, not promises, and written summaries should be read before they are shared.
The agreement
These terms are an agreement between you and Muhammad Taha, a sole proprietor based in Pakistan, trading as Cairn ("Cairn", "we", "us"), for the use of app.rankcairn.com and the services around it ("Cairn"). If you use Cairn for a business, you accept these terms on its behalf and confirm you are allowed to. You must be at least 18. Our privacy policy explains how we handle personal data, and forms part of these terms.
The service and early access
Cairn tracks search and map rankings, connects to services such as Google Search Console, Google Business Profile and Google Ads, builds client portals and reports, and manages tasks. It is in early access: features will change, some will be added and some may be removed, and there may be interruptions while we improve it. We will tell you in advance about a change that takes away something you rely on, where we reasonably can.
Accounts and your team
- Keep your sign in details safe, and tell us at once if you think someone else has used them.
- The account owner decides who to invite, what each person can see, and which share links exist. You are responsible for what happens under your account, including what the people you invite do.
- Give us accurate details, and keep your email address current so we can reach you.
Fees
Cairn is free during early access. If we introduce paid plans, we will tell you at least 30 days before any charge would apply, and you will only be charged if you choose a plan. We may set fair limits on use during early access, such as the number of projects or keywords, to keep the service running well for everyone.
Your data
Everything you and your team put into Cairn, and everything Cairn collects for your projects, is your data, and you keep all rights to it. You give us permission to store, copy, process and display it only as needed to run Cairn for you, to keep it secure, and as the law requires. We do not sell it, and we do not use it to train AI models.
You are responsible for having the right to use the data you put into Cairn, and for the accuracy of what you publish to your clients through it.
Connected services
- When you connect a Google account or any other service, you confirm you are allowed to, and that the business that owns it has agreed to you using it with Cairn.
- Your use of those services through Cairn remains subject to their own terms and policies, including Google's terms, the Google Ads API terms and Google's Business Profile content policies.
- Those services are run by others. If one changes, limits access or stops working, the matching part of Cairn may change or stop, and we are not responsible for their availability or their data.
- Ranking data comes from search data providers and reflects what they measured at the time. Search results vary by person, place and moment, so a position in Cairn is a careful measurement, not a guarantee of what anyone else will see.
Acceptable use
You agree not to:
- use Cairn to break the law, infringe someone's rights, or send spam;
- publish posts or content through Cairn that break Google's policies or mislead people;
- try to reach data that belongs to another account, probe or bypass Cairn's security, or test its vulnerabilities without our written permission (security reports to support@rankcairn.com are welcome);
- overload Cairn, scrape it, or use it to build a competing product;
- copy, resell or sublicense Cairn itself, other than presenting portals and reports to your own clients under your brand, which is what it is for.
Written summaries
Cairn can write progress summaries from your project's numbers using an AI provider. A summary can be wrong or incomplete. Read it before you share it with a client, and edit it where needed. You are responsible for what you choose to send.
Processing your clients' data
When you put personal data about your clients or their customers into Cairn, you are the controller of that data and we are your processor. This section is our data processing agreement with you, and applies alongside the privacy policy. We will:
- process that data only to provide Cairn to you, on your documented instructions, which are these terms and the way you use Cairn, unless the law requires otherwise, in which case we will tell you if we can;
- make sure anyone who handles it is bound to confidentiality;
- protect it with appropriate technical and organisational measures, as described in the privacy policy;
- use only the providers listed in the privacy policy, under contracts with equivalent protections, and tell you before adding or replacing one, so you can object;
- help you respond to requests from people exercising their data rights, and with security, breach notification and impact assessments, where they concern Cairn;
- tell you without undue delay after becoming aware of a breach affecting that data;
- delete or return it when you close your account, as set out in the privacy policy, unless the law requires us to keep it; and
- give you the information you reasonably need to show these obligations are met.
Where the data is transferred out of the UK or the European Economic Area, the safeguards described in the privacy policy apply.
Our property
Cairn, its software, design and name belong to us. These terms give you the right to use Cairn while your account is open, and no other rights. If you send us feedback, we may use it without owing you anything.
Ending
You can stop using Cairn at any time, and ask us to close your account. We may suspend or close an account that breaks these terms, puts Cairn or other people at risk, or is left unused for a long time, and we will give notice first where it is reasonable to. We may also end early access for everyone, with at least 30 days' notice.
When an account closes, you can ask for a copy of your data within 30 days. After that, we delete it as the privacy policy describes.
Disclaimers
During early access, Cairn is provided as it is and as available. To the extent the law allows, we make no promises that it will be uninterrupted or free of errors, or that it will produce any particular ranking or business result. Keep your own copies of anything you cannot afford to lose.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit.
Otherwise, we are not liable for indirect or consequential loss, or for lost profits, revenue, business, goodwill or data. Our total liability arising from these terms or Cairn in any twelve months is limited to the greater of the fees you paid us in those twelve months and 100 US dollars.
Indemnity
If a claim is made against us because of data you put into Cairn, a service you connected without permission, or content you published through it, you will cover our reasonable costs of dealing with it, provided we tell you promptly and let you take part in the response.
Changes
We may update these terms as Cairn changes. If a change matters, we will tell you by email at least 30 days before it takes effect. If you do not agree, you can stop using Cairn before then.
Law and disputes
These terms are governed by the laws of Pakistan, and the courts of Pakistan have jurisdiction, except that if you are a consumer you keep any protection given by the law where you live. Before going to court, please write to us so we can try to resolve it.
If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer these terms without our agreement; we may transfer them to a business that takes over Cairn, and will tell you if we do.
